1. No Spamming.

DO NOT use unsolicited e-mail to promote sales. Use of unsolicited e-mail will result in your Associate account being terminated. You will NOT be paid any commissions and we may take legal action against you to recover any damages.

2. No Misuse of Advertising Materials.

You are authorized to use the advertising materials and information we provide you with. Modification of these materials to misrepresent or mislead may result in your associate account being terminated without payment of any owing commissions. We may take legal action against you to recover any damages as a result of misrepresenting or misleading promotion.

3. No Bundling of any Applications with our DeskMates.

You are not permitted to bundle any applications with our DeskMates. DeskMate downloads may only be effected from Oska's servers using the authorized download links generated by our DeskMate Associate Advertising Center. Any modifications or bundling with our DeskMates will result in your associate account being terminated without payment of any owing commissions. We may also take legal action against you to recover any damages.

4. Don't Reproduce Copyright Protected Materials or Trademarked Materials.

You are authorized to use the advertising materials and information we provide you with and they are clearly identified as such. The rest of the web site is protected by copyright law and you are not authorized to make copies of it. We may take legal action against you to recover any damages as a result of misusing our copyrighted materials.

This includes reproducing our sales order forms on your site. If you reproduce our sales forms on your site you will not be paid commissions as the software embedded in each form necessary to track these sales will not work properly.

5. Payments.

To keep our administration to a minimum we will not cut checks for less than $50. So you have to generate about 7 sales to receive your first payment (Based on RRP of $29.95).

Payments will be made at the end of each month where applicable.

Payments will be made in accordance with the details you provide us when you register. It is YOUR responsibility to ensure that the details you provide us with are correct and up to date.

Payments will be made according to the following schedule:

$0 to $2000 in sales per month 25% commission
$2001 to $4000 in sales per month 30% commission (for all sales that month)
$4001 to $8000 in sales per month 35% commission (for all sales that month)
$8001+ in sales per month 45% commission (for all sales that month)

Commissions are only payable on monies received for sales. Occasionally fraudulent card numbers slip through the cracks and under certain circumstances refunds can be issued. No commission is payable in such cases. If you have already received a commission on a payment which is later reversed, the commission will be offset against your next commission payment.

5. Limitation of Liability.

Whilst we do our best to maintain the system, the associate tracking system is server based and, as with any software or internet site, can crash or be inaccessible. Oska Software accepts no liability in the event of any failure, technical or otherwise or for any site inaccessibility that may affect the sales tracking system. In no event shall Oska Software be responsible for any consequential, special, lost profits, or other damages arising from any failure of the sales tracking system. Without limiting the following, Oska Software shall have no liability for any failure resulting from conditions beyond Oska Software's control.

6. Alterations, amendments and cancellations.

Oska Software reserves the exclusive right to add to, delete, amend or alter the conditions of the DeskMate Associate program at its own discretion. Oska Software further reserves the right to cancel any associate account for any reason it considers justifiable to protect the interests of the DeskMate products and the DeskMate Associate Program.
